What we do with the information you give us when you apply to work at Ultimate Complex Care.
This notice explains how we handle personal data during recruitment, as required by Articles 13 and 14 of the UK GDPR. It sits alongside our main Privacy Policy, which covers everything else.
Ultimate Complex Care Ltd is the data controller for information you provide when applying for a role with us.
We collect the information you give us in your application and at interview: your name and contact details, employment history, qualifications and training, references, and your right to work in the United Kingdom.
Because this is regulated care work, we also process information that the UK GDPR treats as special category or criminal offence data. That includes Disclosure and Barring Service checks, and health information relevant to your fitness for the role and to any adjustments you need.
Our lawful bases are: taking steps at your request before entering a contract for the application itself; legal obligation for right to work and DBS checks required by the Health and Social Care Act 2008 regulations; and legitimate interests for keeping a record of the recruitment decision. Special category data is processed under Article 9(2)(b) in the field of employment and, where relevant, Article 9(2)(h) for health and social care.
Your information is seen by those involved in the recruitment decision and by our HR and compliance staff. We share it with referees you have named, with the Disclosure and Barring Service, and with any recruitment partner acting on our behalf. We do not sell it and we do not use it for marketing.
If you are appointed, your application becomes part of your employment record and is covered by the retention rules for staff records. If you are not appointed, we keep your application for a limited period so we can answer questions about the decision, and then delete it.
Applications from candidates who are not appointed are held for a limited period under our retention schedule so that we can answer any question about the decision, and are then securely deleted. You can ask us at any time what we hold about you and how long we intend to keep it.
You can complain to the Information Commissioner’s Office at ico.org.uk or on 0303 123 1113, although we would rather you came to us first so we can put it right.
